Como una alternativa a los enfoques teóricos jurídicos normalmente utilizados —como los legalistas o formalistas— para el análisis de fenómenos sociales en investigaciones sociojurídicas, en este artículo se expondrán los resultados de las reflexiones metodológicas y empíricas emanadas de una investigación cualitativa previa, en la que el autor empleó como estrategia metodológica “la observación en campo”, diferenciada de la genérica “observación participante”. En dicha investigación se analizó el proceso de resistencia que lideraron tres organizaciones sociales que tienen su rango de (...) acción en la periferia de la Comuna 8 de Medellín, por la reivindicación del derecho a la ciudad y al territorio para esta población, en medio de las obras que comprendieron la ejecución de uno de los proyectos bandera de la administración municipal de Aníbal Gaviria : el Cinturón Verde Metropolitano - Jardín Circunvalar. A través de este análisis se logró evidenciar una constante tensión entre lo local y lo global, y un trabajo mancomunado entre organizaciones de base social para resistir a una concepción hegemónica de la globalización y construir un derecho “desde abajo”. One of the great problems of caregivers and health professionals in recent times has been the so-called compassion fatigue and its association with burnout syndrome. Another pole of compassion has been described in terms of compassion satisfaction. Both propositions could be problematic in the caregiving setting. This is an analytical reflective article that through an apparent aporia tries to problematize and propose a theoretical synthesis that allows to denote compassion as a virtue in Aristotelian terms. To this end, it resorts (...) to etymologies, translations and mainly to the classical theoretical references regarding compassion fatigue, compassion satisfaction and, of course, Aristotelian ethics. This is a theoretical bet that leaves open the discussion regarding the dichotomies compassion fatigue and compassion satisfaction; apathy and hyperpathy; and proposes to rethink compassion as a virtue, a reasoned middle ground, contextualized in the framework of care between two possible excesses. Relationships between degree/area of academic formation and religious and Darwinian views are controversial. This study aimed to compare the religious beliefs and acceptance of Darwinian evolution between two contrasting South American scientific communities (Chile and Colombia), accounting for different degrees and areas of academic formation. In 2018, 115 last year bachelor students (surveyed as freshmen in 2014 for a previous study) from Chile, and 283 first/last year bachelor students, graduate students, and professors from Colombia, all belonging to biology, chemistry, or (...) physics, were surveyed. Chilean students/faculty were significantly more agnostic/atheist, more accepting of Darwinian evolution, and less creationist than their Colombian counterparts. Academic degree and area differently affected these views in both countries, as only in Chile there was a clear tendency among biologists and physicists with higher degrees to hold less religious and creationist views. Marked differences between the history, socioeconomic contexts, and especially in high school and university curricula of both countries might explain these results. (shrink)

El presente trabajo pretende indagar el problema de la vida intelectual creadora en el ámbito universitario y el impulso de la realización de «lo mejor» con visión, claridad de pensamiento y razón de la vida desde el pensamiento mariano y superar de este modo el peligro de quedarse instalado en el academicismo filosófico, que enfatiza la erudición, la acumulación de información más que el aprendizaje, la relaciones interpersonales, el pensamiento propio u otras maneras de ver la realidad.

What is the correct concept behind measures of inflation? Does money cause business activity or is it the other way around? Shall we stimulate growth by raising aggregate demand or rather by lowering taxes and thereby providing incentives to produce? Policy-relevant questions such as these are of immediate and obvious importance to the welfare of societies. The standard approach in dealing with them is to build a model, based on economic theory, answer the question for the model world and then (...) apply the results to economic phenomena outside. Data come in, if at all, only in testing a limited number of the model's consequences. Despite some critical voices, economic methodology too has by and large subscribed to a "theory first" approach to applied economics. Error in Economics systematically develops an alternative to the theory-based orthodoxy. It places the methodical study of evidence at the centre of the scientific enterprise and thus provides a foundation for a methodology of evidence-based economics. But the book does not stop at the truism that claims should be based on the best available evidence. Rather, detailed studies in the areas of measurement, causal inference and policy analysis show what it means for a claim to be evidence-based in the context of a concrete case. The examples discussed concern topics as diverse as consumer price indices, radio spectrum auctions, the transmission mechanism, natural experiments on minimum wages and the evaluation of counterfactuals for policy. In this book, Reiss argues in favor of a tight fit between evidence, concept and purpose in our causal investigations in the sciences. There is no doubt that the sciences employ a vast array of techniques to address causal questions such as controlled experiments, randomized trials, statistical and econometric tools, causal modeling and thought experiments. But how do these different methods relate to each other and to the causal inquiry at hand? Reiss argues that there is no "gold standard" in (...) settling causal issues against which other methods can be measured. Rather, the various methods of inference tend to be good only relative to certain interpretations of the word "cause", and each interpretation, in turn, helps to address some salient purpose but not others. The main objective of this book is to explore the metaphysical and methodological consequences of this view in the context of numerous cases studies from the natural and social sciences. (shrink)

Jeffrey Friedman’s Power Without Knowledge argues forcefully that there are inherent limitations to the predictability of human action, due to a circumstance he calls “ideational heterogeneity.” However, our resources for predicting human action somewhat reliably in the light of ideational heterogeneity have not been exhausted yet, and there are no in-principle barriers to progress in tackling the problem. There are, however, other strong reasons to think that disagreement among epistocrats is bound to persist, such that it will be difficult to (...) decide who has “the right answer” to a given technocratic problem. These reasons have to do with competing visions of the good society, fact/value entanglement, and the fragility of the facts of the social sciences. (shrink)

This book is a full survey of the philosophy of tragedy from antiquity to the present. From Aristotle to Žižek the focal question has been: why, in spite of its distressing content, do we value tragic drama? What is the nature of the 'tragic effect'? Some philosophers point to a certain kind of pleasure that results from tragedy. Others, while not excluding pleasure, emphasize the knowledge we gain from tragedy - of psychology, ethics, freedom or immortality. Through a critical engagement (...) with these and other philosophers, the book concludes by suggesting an answer to the question of what it is that constitutes tragedy 'in its highest vocation'. There are 4 main arguments for euthanasia: (1) arguments appealing to consistency (e.g., from passive to active euthanasia); (2) the argument from respect for autonomy; (3) appeals to justice; and (4) the argument from interests (mercy or relief of suffering). I will argue that only the last is directly relevant to active euthanasia as a medical intervention, though arguments together from autonomy and justice can in practice (through the backdoor) provide a ground for voluntary active medical euthanasia (AME).

I respond to some challenges raised by my critics. In particular, I argue in favour of six claims. First, against Alexandrova and Northcott, I point out that to deny the explanatoriness of economic models by assuming an ontic (specifically, causal) conception of explanation is to beg the question. Second, against defences of causal realism (by Hausman, Mäki, Rol and Grüne-Yanoff) I point out that they have provided no criterion to distinguish those claims a model makes that can be interpreted realistically (...) (the model's ?causal content? or claims it makes about causal powers or mechanisms) and those the realist can safely ignore. Third, I point out that Hausman's and Rol's claims about robustness plus the empirical observation that economic models are hardly ever robust to the right kinds of specification changes imply that these models do not explain (which is problematic as my original article argued). Fourth, I point out that Sugden's response still leaves an important question unanswered, viz. what makes economic models explanatory. Fifth, I sketch an alternative, instrumentalist account of explanation and argue that it would fit Sugden's bill. Sixth, I point out that under this account of explanation, economic models would come out as non-explanatory, which brings us back to Alexandrova and Northcott's account and its associated difficulties. The ?explanation paradox?, therefore, remains unscathed. (shrink)

In recent years, a number of philosophers have attempted to fix paradoxes of the counterfactual account of causation by making causation contrastive. In this framework, causation is understood to be not a two-place relationship between a cause and an effect but a three or four-place relationship between a cause, an effect and a contrast on the side of the cause, the effect or both. I argue that contrasting helps resolving certain paradoxes only if an account of admissibility of the chosen (...) set of contrasts is given. I show by means of numerous examples that it is contextual features that determine admissibility. This way, context becomes part of the semantics of causation. I finally argue that once contextualised, explicit contrasting is redundant: causation is therefore a three-place relationship between a cause, an effect and a context. (shrink)

Several European and North American states encourage or even require, via good Samaritan and duty to rescue laws, that persons assist others in distress. This paper offers a utilitarian and contractualist defense of this view as applied to corporations. It is argued that just as we should sometimes frown on bad Samaritans who fail to aid persons in distress, we should also frown on bad corporate Samaritans who neglect to use their considerable multinational power to undertake disaster relief or to (...) confront widespread social ills such as those currently befalling public health (obesity) and the environment (climate change). As such, the corporate duty to assist approach provides a novel justification for sustainable business practices in such cases. The paper concludes by arguing that traditional stakeholder approaches have not articulated this duty of assistance obligation, though a new utilitarian stakeholder theory by Thomas Jones and Will Felps may be coextensive. This paper is a review and critical discussion of John Broome’s Rationality Through Reasoning. In particular, it engages critically with Broome’s view on the independence of normative reasons and rationality, his construal of the capacity, property, and requirement senses of “rationality”, and his account of reasoning as a conscious, rule-following operation on mental contents.

The Royal Institute of Philosophy volume of which this paper is an introduction is on the theme of ‘Expanding Horizons’. But what does it mean for philosophy to fruitfully expand its horizons? The contributions to the volume suggest at least five profitable ways. First, by looking to other philosophical traditions for new perspectives on familiar questions and alternative methods, questions, and ways of understanding. Second, by looking to what has been neglected or overlooked in our own histories of thought. Third, (...) by developing novel methods, in addition to argument, for investigating philosophical issues. Fourth, by embracing different modalities for doing philology, such as the literary. Fifth, by reflecting on the practice of comparative philosophy to better understand the extent to which philosophy can and should be universal. Together, these approaches both increase the range of voices heard in philosophy and the scope and ambition of the discipline. (shrink)

We build on Ainslie's discussion of willpower by highlighting another common misconception in the literature: the conflation of self-control and willpower. In our commentary, we identify this issue and discuss the importance of recognizing willpower not as synonymous with self-control, but rather as a subset of self-control. We describe a set of upstream strategies as more effective alternatives to willpower.

The concept of “philosophical normalization” has become common place, recently questioned in the narrative of the historical process of philosophy in Latin America. From the theory of layers of time raised by R. Koselleck this paper proposes a critical review of this concept.

We look on Fernán Pérez de Guzmán as an exile not only because he lived out the last thirty years of his life in the relative seclusion of his estate in Batres; he is an exile, too, because as a poet he has long been banished from critical acclaim. For an enthusiastic view, one has to go back to the 1860s and the eulogy of the literary historian José Amador de los Ríos, according to whom Fernán Pérez's graceful didacticism deserved (...) “[el] aprecio de la verdadera crítica.” Since then, “the appreciation of true critics” has been reserved for what is now considered a canonical work of prose history, the Generaciones y semblanzas, whereas most of his poetry has been condemned for stylistic inelegance — ironically, as we shall see, one of the very qualities he seems deliberately to have cultivated. This is the first instalment of a two-part paper on the counterfactual theory of causation. It is well known that this theory is ridden with counterexamples. Specifically, the following four features of the theory suffer from problems: it understands causation as a relation between events; counterfactual dependence is understood using a metric of similarity among possible worlds; it defines a non-discriminatory concept of causation; and it understands causation as transitive. A number of philosophers have recently proposed that causation is contrastive (...) because making contrasts explicit defuses counterexamples. A contrastive causal claim has the following form: C rather than C* causes E rather than E*, where C* and E* are alternative or contrast events. In this paper, I show that making contrasts explicit does indeed defuse some counterexamples. However, I also argue that the examples discussed in the literature all share a common feature, viz. that the original causal judgement is ambiguous in one way or another. Contrasting does not help with counterexamples that do not have this feature. Part II of this paper then takes up the hard cases. (shrink)

Advances in brain–brain interface technologies raise the possibility that two or more individuals could directly link their minds, sharing thoughts, emotions, and sensory experiences. This paper explores conceptual and ethical issues posed by such mind-merging technologies in the context of clinical neuroethics. Using hypothetical examples along a spectrum from loosely connected pairs to fully merged minds, the authors sketch out a range of factors relevant to identifying the degree of a merger. They then consider potential new harms like loss of (...) identity, psychological domination, loss of mental privacy, and challenges for notions of autonomy and patient benefit when applied to merged minds. While radical technologies may seem to necessitate new ethical paradigms, the authors suggest the individual-focus underpinning clinical ethics can largely accommodate varying degrees of mind mergers so long as individual patient interests remain identifiable. However, advanced decisionmaking and directives may have limitations in addressing the dilemmas posed. Overall, mind-merging possibilities amplify existing challenges around loss of identity, relating to others, autonomy, privacy, and the delineation of patient interests. This paper lays the groundwork for developing resources to address the novel issues raised, while suggesting the technologies reveal continuity with current healthcare ethics tensions. (shrink)

Explaining socio-economic phenomena is one important aim of economics. There is very little agreement, however, on what precisely constitutes an adequate economic explanation. Starting from the very influential but defective ‘deductive-nomological model’ of explanation, this article describes and criticizes the major contemporary competitors for such an account (the probabilistic–causal, the mechanistic–causal and the unificationist models) and argues that none of them can by itself capture all aspects of a good explanation. When seeking to explain a socio-economic phenomenon it should therefore (...) be borne in mind that different types of explanation serve different purposes. (shrink)

Although political pluralism can have an ethical justification, it does not need one. Political pluralism can be justified on the basis of an epistemological argument about what we can claim to know, one which has a normative conclusion about how strongly we ought to believe. This is important because for pluralism to command wide assent, it needs something other than an ethical justification, since many simply will not accept that justification. Thus understood, we can see that current threats to pluralism (...) come not just from authoritarian movements but from populism, which has already infected mainstream politics. (shrink)
